WTF!!! New law on kids ATV's
Sorry guys, I just had to start a new thread on this one

the future for kids that ride
For anyone who does not know,
It is now illegal to sell ANY ATV designed for a child under the age of 13. This is across the country!!!!!
I know, I didn't beleive it either. The fact remains, that I myself, voted for this law, with out even knowing it. In our last election, one of the prop's was to make it illegal to sell toys in the United States with any amount of lead in them, due to lead exposure. They have extended this law to include all ATV's and Snowmobile's.
This is a law that srtikes very close to all of us, and I personally am very pissed, because I myself voted for this law. However never the less, I would like to ask all of you, my fellow ATV enthusiast to combine with the rest of the nation with people like ourselves, and sign what ever petition you can, in order to get this over turned. I am posting a link to a petition, but I am sure there are more, somehwhere. If you can, please post it here, so we all can fight this.
It is one thing to try and take land away from us, and it may just be possible that we are winning that side of the battle. Now it seems they are working on the other end of things, affecting our kids!
I don't know about you guys, but I do all of this for my kids! I love going out and riding, but the smile on my children's faces make all the struggle, effort, and money worth putting into in this sport we love so much.
Please post any and everything you can find about this law here or in Lucky's thread. As of now, I am almost positive the law only extends to the new sale of any ATV's designed for children under the age of 13. However their are many who are spreading what I only hope to be Rumors, that the law also says that the children can not ride, or that stores will no longer be able to sell parts or any apparel for children either. This meaning Helmets, gloves, chest protectors, etc. Again, as far as I am concerned these are only rumors and there is no info on the BLM's website that pertains to children not being able to ride. Only the fact that they need to be certified by the state in a safety course.
Please take this seriously and help us all out by doing whatever we can. I am not a person who has ANY type of experience in matters such as this, so if there is anything we all should know, please bring it to all of our attentions.

They are trien everything to put an end to anything that we enjoy. It is sad that with all the beatin starved and abused children in our country they are spending all the time an money to take away things that we all do with our children, witch helps us get closer to them. keeps the older ones of the streets, It is very sad!

Don't know, but they won't hear us unless we speak up, Check out DuneDog's thread too!
There may be hope yet, check out pgs 9 & 10, of the report released by the CPSC yesterday..

Youth sized ATVs and dirt bikes are still banned. We need your help to continue to build enough pressure to get the ban overturned. It is unlikely that the Consumer Product Safety Commission (CPSC) will act to approve the Motorcycle Industry Council’s petition to grant regulatory relief. This means we need Congress to act.

I'm writing today as a citizen who enjoys riding ATVs / dirt bikes. I urge you to co-sponsor and support S. 608 which will exempt youth model all-terrain vehicles and off-highway motorcycles from the lead content provisions of the Consumer Product Safety Improvement Act (CPSIA).
Although the powersports industry has demonstrated that the lead content in the metal parts of ATVs and dirt bikes pose no risk to children's health, the Consumer Product Safety Commission's (CPSC) recent approval of a final rule imposing strict standards for excluding products from the new lead content limits makes clear that CPSC will not provide relief for youth model ATVs or dirt bikes. Congress needs to step in and make immediate amendments to the CPSIA to ensure that reasonable exclusions can be made for these products, which are piling up in stores and dealerships across the country, needlessly resulting in millions of dollars in lost sales and costs at a time when our economy and these small businesses can least afford it.
But the unintended consequences of this ban go way beyond the business and financial ramifications - it affects me personally, and it affects family and friends who ride with their children, because it destroys the chance for families to enjoy these outdoor recreational activities together. AND it poses a potentially huge safety risk if, as an alternative to having the kid-sized vehicles available, parents opt to put their kids on larger, adult-sized vehicles. PLUS, there is mass confusion. Should kids who race in off-road competitions even go to events? Will parents be able to buy critical replacement parts for their kids' ATVs or dirt bikes, like brake pieces or valve stems? Everyone suffers: dealers, manufacturers, aftermarket, motocross event operators, and especially families with children who are being denied their right to ride. And ride safely.
When the new lead standard took effect on February 10, 2009, youth models of ATVs and dirt bikes designed and intended primarily for children 6 to 12 years of age became classified as banned hazardous substances and dealerships in our area were forced to remove these perfectly good products from showrooms. Components in youth model ATVs and dirt bik es that contain small quantities of lead such as valve stems on tires, aluminum in some brake components, and terminals on batteries, do so to address safety (such as machining the deep grooves on tire valves to assure tire air retention) or for functionality (such as the lead in battery terminals, needed to conduct electricity).
The sad irony is that these youth models were created with the support of the CPSC and consumer advocates to give children a safer alternative to larger, faster adult size models. These long-term efforts to promote child safety are now seriously jeopardized. In addition, youth rider training to encourage the safe and responsible use of ATVs and dirt bikes is jeopardized because new youth models and parts and accessories for them are no longer available. As an ATV / dirt bike rider, and one who has respected the law and encouraged responsible riding, I find this to be unacceptable. The lead in those vehicles does not pose a risk to children 's health. Congress needs to stop this ban - NOW.
I respectfully ask that you co-sponsor and support S. 608 so youth ATVs and dirt bikes again will be available for sale and safe and responsible use.

CPSC Staff Recommends Against Exempting Children's Dirt Bikes And ATVs From Strict Anti-lead Law
PICKERINGTON, Ohio -- The staff of the Consumer Product Safety Commission (CPSC) is recommending that the agency refuse to grant an exemption for youth-model off-road motorcycles and all-terrain vehicles (ATV) from a new anti-lead law, the American Motorcyclist Association (AMA) reports.
The law, the Consumer Product Safety Improvement Act (CPSIA) that took effect in February, has stopped the sale of dirt bikes and ATVs for children 12 or under. The law was meant to protect children from dangerous levels of lead in toys, but it was written so broadly that it also governs such things as children's books, clothes, motorcycles and ATVs.
Under the CPSIA, all youth products containing lead must have less than 600 parts per million by weight. The CPSC has interpreted the law to apply to various components of youth-sized off-highway vehicles (OHV) including the engine, brakes, suspension, battery and other mechanical parts. Even though the lead levels in these parts are small, they are still above the minimum threshold.
The CPSC staff admits that the risk of exposure to lead from OHVs is relatively low. But the staff told the commissioners that the law is written so strictly that no lead absorption into the body is allowed. As a result, motorcycles and ATVs shouldn't be exempt from the law.
In light of this new recommendation, Ed Moreland, AMA vice president of government relations, is urging all motorcyclists and ATV riders to contact their U.S. Senate and House members. Moreland wants riders to ask their lawmakers to support letters being circulated on Capitol Hill that ask the CPSC to grant exemptions from the lead law for kids' dirt bikes and ATVs.
"The CPSC is expected to vote on the staff recommendation soon," Moreland said, "so motorcyclists and ATV riders need to contact their federal lawmakers now."
Moreland added that riders should also tell Congress to support two bills aimed at righting this oversight: H.R. 1587 and S. 608.
The easiest way to take action is by visiting American Motorcyclist: The Official Site of the American Motorcyclist Association, clicking on the "Rights" section and then "Issues and Legislation." AMA members will also find a card in the May issue of American Motorcyclist addressed to the CPSC that they can mail.
Interested parties can also sign up in the "Rights" section to get e-mail Action Alerts to keep abreast of issues threatening motorcycling and ATV riding, and to take action.
